Terms of Service
These Terms of Service (the "Terms") are a binding agreement between you and FreebieDay, Inc., a Delaware corporation ("FreebieDay," "we," "us," or "our"), the maker of Home Manager. They govern your use of the Home Manager mobile application, website, text-messaging features, and related services (together, the "Service"). By creating an account, joining a household, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to create an account. Minors may participate in the Service only as household members whose profiles are created and managed by a parent or legal guardian who holds an account.
2. Accounts and Phone Verification
You sign in through a supported login provider and are responsible for safeguarding access to that provider account and your device. You agree to provide accurate information, including a phone number you own or control when completing phone verification. You are responsible for activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.
3. Households and Roles
The Service organizes information into shared households. Information added to a household — schedules, tasks, lists, memories, member and pet profiles, and assistant conversations — is visible to that household's members. The household administrator (typically its creator) has authority to manage the household, including adding and removing members, editing member profiles, managing invitations, and deleting household data. By joining a household you acknowledge the administrator's authority over its shared data.
A subscription covers one household. A household supports up to 10 primary members, plus connected family, friends, and caregivers (such as invitees who interact with the household by text message without holding an account). We may adjust these limits prospectively with notice as described in Section 4.
4. Subscriptions, Trials, and Billing
Parts of the Service require a paid subscription. New households receive a 14-day free trial. Unless you cancel before the end of the trial or current billing period, your subscription automatically renews and the applicable fee is charged through your chosen billing channel: the Apple App Store, Google Play, or our web checkout provider.
- Purchases made through the Apple App Store or Google Play are billed and managed by Apple or Google; cancellations and refund requests are handled under the applicable store's terms and processes.
- Purchases made through our web checkout are billed and managed by our payment provider; you can cancel through the management link provided at purchase, and refund requests are handled under that provider's terms.
- Canceling stops future renewals; fees already paid are non-refundable except as required by law or the applicable store or provider's policy.
We may change subscription prices prospectively. If we do, we will provide notice in advance, and the change will take effect at your next renewal, giving you an opportunity to cancel first.
5. Text Messaging (SMS) Terms
By entering your phone number and requesting a verification code — or by replying YES to a household invitation — you consent to receive text messages from Home Manager, including verification codes, family invitations, reminders and briefings, and replies from the Milo assistant. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out and HELP for help. Carriers are not liable for delayed or undelivered messages. 6. Acceptable Use
The Service is intended for personal, non-commercial household organization. You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Store or share content that is unlawful, infringing, defamatory, harassing, or harmful
- Attempt to access another household's or user's data without authorization
- Verify or use a phone number you do not own or control, or send invitations to people without a reasonable basis to believe they consent to being contacted
- Interfere with or disrupt the Service, probe or test its vulnerabilities, or circumvent its security or rate limits
- Reverse engineer, scrape, or copy the Service or use it to build a competing product
- Use automated systems to access the Service except through interfaces we provide
- Impersonate any person or misrepresent your affiliation with anyone
7. Your Content
You and your household retain ownership of the content you add to the Service — profiles, photos, events, tasks, lists, memories, and messages ("User Content"). You grant FreebieDay a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display User Content solely as needed to operate, provide, secure, and improve the Service for you and your household. This license ends when the relevant content is deleted from the Service, subject to limited backup retention. You are responsible for your User Content and represent that you have the rights needed to share it, including any information you add about other people.
8. AI Assistant Disclaimer
The Milo assistant and related features (briefings, suggestions, summaries) are powered by artificial intelligence. AI-generated output may be inaccurate, incomplete, or outdated. It is provided for convenience only and is not medical, legal, financial, veterinary, or emergency advice. Always verify time-sensitive or important information — appointments, medication schedules, deadlines — against an authoritative source, and never rely on the Service for emergencies. If you have an emergency, contact emergency services.
9. Third-Party Services
The Service interoperates with third-party services, including calendar providers (such as Google, Outlook, and Apple), login providers, app stores, and payment processors. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. Connecting a third-party calendar authorizes us to access the calendar data needed to display and sync events; you can disconnect at any time from within the app.
10. Intellectual Property
The Service — including its software, design, text, graphics, logos, and the Home Manager and Milo names — is owned by FreebieDay, Inc. or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal household purposes in accordance with these Terms. No rights are granted except as expressly set out here.
11. Termination
You may stop using the Service, leave a household, or delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us or other users, or if we discontinue the Service (with reasonable notice where practicable). If a household is deleted or its subscription ends, its members lose access to that household's shared data as described in the Privacy Policy. Sections that by their nature should survive termination (including Sections 7, 8, and 12–15) survive.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT NOTIFICATIONS AND MESSAGES (INCLUDING SMS AND PUSH NOTIFICATIONS, WHICH DEPEND ON THIRD-PARTY NETWORKS) WILL BE DELIVERED ON TIME OR AT ALL. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEBIEDAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR MISSED APPOINTMENTS OR EVENTS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless FreebieDay and its officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at the address below; most concerns can be resolved this way. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Delaware, and you and FreebieDay consent to their jurisdiction, except that either party may seek relief in small-claims court where eligible. Nothing in this section limits rights you may have under mandatory consumer-protection laws of your place of residence.
16. General
- Changes to these Terms. We may update these Terms as the Service evolves. If we make material changes, we will take reasonable steps to notify you (for example, through the app or by updating the "Last updated" date). Continued use of the Service after changes take effect means you accept the revised Terms.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
- Entire agreement. These Terms, together with the Privacy Policy and SMS Opt-In Policy, are the entire agreement between you and FreebieDay regarding the Service.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
